LICENSE AGREEMENT FOR END USER
If You do not agree with any of these conditions, You may not use the service.
In the mobile app Enigma no access to emergency services in the region. Function Enigma is not a replacement for your ordinary mobile or fixed line telephone and does not allow you to make emergency calls to emergency services. You should use alternative ways of communication for emergency calls if necessary.
We are not responsible for restrictions of use in some countries, our license application. The use of the application, it is your responsibility to ensure legal use of our app, check the laws of the country in which you are located. For the use of mobile data during the exchange of messages and calls in mobile app Enigma, you may be charged according to your tariff plan.
- Volume license
This License is a limited, non-exclusive, non-transferable, not sublicensable license to use the Licensed application on any mobile device or personal computer owned by you or managed by you. You may not distribute or provide Licensed Application available on the Internet, and it cannot be used by multiple mobile devices connected simultaneously to a single account. You may not rent, lease, lend, sell, redistribute or sublicense the Licensed Application. You may not copy (except as expressly permitted by this license), decompile, disassemble, attempt to derive the source code of, modify, or create derivative works based on the licensed application, any updates, or changes any part of them. In addition, any commercial copying or distribution, publication or use of the website, apps or any content, software, codes, data or materials from the website, the mobile application is strictly prohibited unless You have received prior written permission from us. Any attempt to do so is a violation of our rights. If you violate these restrictions you may be subject to criminal or administrative prosecution with damages. The terms of the license will govern any upgrades provided by us that replace and/or Supplement our service, unless such updates are accompanied by a separate license, in this case, the license terms shall prevail.
- Changes to the terms of this license
Enigma may amend the terms of this license. Enigma will publish the changes at https://xn--90agcaabgdi6bje6bgca.xn--p1ai/ The changes will take effect from the date of publication.
Please review this license, and check for updates. You understand and agree that your consent to the terms of this license indicates Your acceptance of the updated future conditions. If You do not agree to the amended terms, you may terminate your relationship with Enigma in accordance with paragraph 4.
- Consent to use of data
As Enigma receives, collects and uses information about you during your use of the service, including personal information, you give your consent.
Using the Licensed Application, you understand and agree that we may collect and use technical and other data, including, but not limited to technical information about your mobile device, namely: location, address book, statistical information about the use of the mobile phone name of the cellular operator, system and application software, peripheral devices. We can use this information to improve our service and for other purposes.
4.1 the License is effective until terminated by you or us. You can unsubscribe from our service Enigma at any time. If you use our free service, You may simply discontinue using the service or delete our licensed application. If you used the pay functionality of our application in your personal account remained “coins”, deleting the licensed application with complete removal of the account, the funds for the remaining “coins” us will not be returned. If you are registered on our service, You may request us to delete your User account (as defined below). Enigma has the right to terminate your rights under this license without notice if You breach any of the terms of this license. After termination of the license you shall cease all use of the Licensed application, and destroy all copies, full or partial, of the licensed mobile App.
4.2 in addition, the Enigma has the right to terminate or suspend Your use of the service at any time:
4.2.1 in case of non compliance with the conditions of this license;
4.2.2. if Enigma suspect that your use of the service in violation of any law or the rights of third parties;
4.2.3 if if Enigma suspects that you are trying to use unfair or inappropriate use of our service;
4.2.4 if if Enigma will suspect that you are using any of our products fraudulently or that your “User account” is used by a third party fraudulently;
4.2.5 if You have purchased “Enigma coins” (as specified below) in the unauthorized way;
4.2.6 immediately, if required due to changes in legislation/regulations and decisions of the competent authorities in your country of residence;
4.3 Enigma you must cease access to the service, where applicable. We reserve the right to remove user accounts that have been inactive for more than one (1) year.
5.1 once you have downloaded, installed Licensed application and become a user Enigma you and you can call from any other Enigma numbers in the system for free (paying traffic from the Internet at your expense). You can disable “Enigma the service at any time by changing the settings of the application.
5.1.1. The application extends only to persons older than 18 years. If you have downloaded and registered your account is in violation of the age restrictions Enigma is not responsible for moral and material damage. You waive all claims.
5.2 the service also allows users to send text, photos, videos (“user content”). These custom materials can be placed, at the private and for public display that is may be visible to other users of the service who are registered in our system. You acknowledge and agree that any data you share may be viewed by other users that are connected to our system. You do not retain copyright in Your user content. You understand and agree that Enigma is not responsible for the confidentiality of any content posted by you in our service. You are solely responsible for your own user content and the consequences of posting or publishing. Custom publications do not reflect the views or opinions Enigma and Enigma makes no warranties regarding the reliability, accuracy or legal status of any user content. With respect to your user Content, You affirm, represent and/or warrant that: 1. you own or have the necessary licenses, rights, consents, and permissions to use and publish your content, 2. you have the written consent, or permission for the use of your links from the copyright holder. Please note, by submitting the user Enigma the content, you hereby grant us a non-exclusive, royalty-free, license to use, reproduce, distribute, display this content in any media formats and through any media channels. You also grant each user of the system a non-exclusive license to access Your user Content through the service. You also agree that you will not violate any restrictions listed in prohibited uses set forth in paragraph. Enigma does not support any user content and any opinion, recommendation, or advice expressed therein, and we disclaim any liability in connection with user content. Enigma does not permit copyright infringement and violations of intellectual property rights in the service, we will remove all content and user submissions if we are properly notified. To give us notice of infringement of copyright or other rights, please write to us in feedback form.
5.2.1 The application includes a locking mechanism user. You can block any user. After blocking a user, the user will not be able to write or call . Unblock user you can “Settings” – “Privacy” – “Blocked users”. To lock the user, you can benefit in two ways:

The service allows users to access their own or to participate in other public groups in our mobile application.
This is a public group conversation, including between members of the group who have a common interest and signed her.
We reserve the right (but not the obligation) to remove or deny the posting of any Content on the service, suspend or terminate users, and to block participants Enigma public group without liability to you. We also reserve the right to respond to User requests provided via Enigma the application, to protect the rights, property, or safety Enigma, its users and the public.

5.3 in the course of using the service, You may encounter content that may be deemed offensive, indecent or objectionable. Nevertheless, you agree to use our service at your own risk and we will not have any liability to you for content that may be offensive, indecent or objectionable. You agree not to use the service in any unlawful manner, including but not limited to, trespassing or burdening network capacity. If you have your own theme group, you can also administer it. You as the administrator beside each comment in the group there is a red cross. By clicking on the cross, you can remove any post or block the user. If you find such content in another group, you may complain to the group owner or administrator of the application.
5.3.1 In our application of the concept each group has its own user – administrator. If the group have a not desired content , users can complain about this group:
- Write a complaint to the user administrator of the group.
- If the owner – the administrator has not removed the content, the user can write a complaint to the administrator of the application. This can be done in the “Settings” – “About” – “Write to us”. In these ways we control the content in the application. Installation functions flag an inappropriate content, not provided by the application concept.
- User – the administrator can delete the not desired content, or block the user in the group. If you go in a group as an owner – manager the next to each post a comment, on the right side there is a red cross. By clicking on the red X displays a message “remove content”, “Block User”.
5.4 we do not claim that our service is available for use anywhere. If you decide to access our services, You do so on your own initiative and are responsible for compliance with any applicable laws, including, but not limited to applicable local laws. We reserve the right to change, suspend, remove, or block access to our services at any time without prior notice. We are not responsible for the removal of or disabling of access to our service. We may also impose limits on the use of or access to our service without notice or liability.
5.5 Enigma may automatically check your version of the Licensed application. Enigma has no obligation to provide any updates. However, Enigma can :
(a) require you to download and install updates;
- b) automatically download and install updates for your device.
5.6 Enigma not consider proposals or ideas for new products, technologies, promotions, product names, in the form of feedback. If you send any feedback to Enigma through the website, social networks or otherwise, you acknowledge and agree that Enigma is not under any obligation of confidentiality in respect of them.
5.7 You may link to our website on your website, belonging to you, if you make it legal and not discrediting our reputation way. Enigma may revoke the permission to link to the website at any time in its sole discretion.
5.8 You as the application, the user can block another user at your discretion without quantity limitations. After blocking user can not write or call you with the application. In administratra group has a red X next to all messages by clicking on the cross can be a message to delete the message or block this user has written a message. After blocking the user administrator group, the user can no longer write messages in this group yet. This user is automatically removed from the list of users in this group.
5.9 All users have the possibility to send a complaint to the user or content. You must go to the section Settings – About – Write to us. We will review your complaint and within 24 hours to remove content, block the user, block the group.
- Your Obligations
6.1 if you decide to use the service to call a number not registered in our system Enigma, you should understand that the fee for an outgoing call will be charged in accordance with tariffs of your mobile operator. You are responsible for all activities that occur under your user account. You agree to immediately notify Enigma of any unauthorized use of Your account or any other breach of security in relation to Your account. Enigma is not responsible for any loss that you may incur as a result of someone else using Your account, with or without your knowledge. In addition, you can be held liable for any losses incurred by us or another party due to someone else using Your User account. Therefore, we recommend you to choose a password that is hard to guess and consists of letters, numbers and symbols. Enigma is not responsible for failure to comply with the obligations set forth in this paragraph.
6.2. You may not:
6.2.1 intercept or monitor, damage or modify any communication which is not intended for you;
6.2.2 use any type of “spiders”, viruses, worms, Trojan horses or other programs to distort, delete, damage, simulate application Enigma;
6.2.3 send unsolicited Communications (also known as “spam”, advertising);
6.2.4 forward any third party to material which is offensive, harmful to minors, indecent or other undesired character;
6.2.5 use the service to deliberately humiliate, degrade, threaten, intimidate or invade the private life of third persons; Not to use not standard lexicon.
6.2.6 use (including your name and/or profile picture) any material or content that belongs to third parties, if you don’t have rights or permission.;
6.2.7 collect any personal information, including names, photographs accounts;
6.2.8 impact or attempt to impact the availability by service (DDoS) attack.
- A waiver.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE, INCLUDING ALL HEADINGS SHALL BE AT YOUR OWN RISK. OUR SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS IN RESPECT OF SERVICES PROVIDED, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. WE DO NOT GUARANTEE THE UNIMPEDED USE OF THE SERVICE, THE SERVICE, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US TO YOU, MAY NOT BE CONSIDERED AS WARRANTY. IF ANY SERVICE RENDERED TO US WAS PERFORMED WITH ANY DEFECTS, YOU STILL PAY THE FULL COST OF THE SERVICES COMPLETELY.
- Limitation of liability.
UNDER ANY CIRCUMSTANCES WE ARE NOT RESPONSIBLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, INTERRUPTION OF BUSINESS OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, RESULTING FROM THE USE OR INABILITY TO USE OUR SERVICE, FOR ANY REASON, IRRESPECTIVE OF THE TERRITORY. Under no circumstances will our total liability to you for all damages may not exceed the sum of thirty dollars ($30.00).
